Terms of Service

1. Introduction
Welcome to CarbonVerified.uk, a trading name of Paul Jacobs (the "Supplier," "we," "our," or "us"). Our principal place of business is located at 43 Saint Johns Road, Newport, Isle of Wight, PO30 1LW. By accessing our platform, calculating your emissions, or upgrading to a Pro membership, you agree to be bound by these Terms of Service.
Our service is designed specifically for UK Small and Medium Enterprises (SMEs) to measure, report, and verify their carbon footprint.
2. Acceptable Use Policy
We rely on the honesty and integrity of our users to maintain the value of our verified network. You agree that you will NOT:
- Falsify energy usage data, bills, or evidence uploaded to the platform.
- Use our service for any illegal purpose or to mislead stakeholders, customers, or regulators.
- Attempt to reverse-engineer our calculation engine or scrape data from our platform.
- Share your account credentials with unauthorized third parties. If you use a third-party login (e.g., Google Sign-in), you are responsible for maintaining the security of that third-party account.
WARNING: We reserve the right to immediately terminate the account of any user found to be purposely inflating or under-reporting their data.
3. Payment Terms
Pro Membership
Our primary paid tier is the "Pro" plan, billed at £19.00 per month or £190.00 per year. All prices are inclusive and no VAT is currently charged as we are below the UK VAT registration threshold.
- Payment Processing: All payments are securely handled by Stripe. We do not store your credit card details on our servers.
- Renewal: Subscriptions renew automatically each month or year (depending on your plan). You can cancel anytime from your dashboard.
4. Limitation of Liability
While we use official UK Government (DESNZ) conversion factors to ensure accuracy, our reports are estimates based on the data you provide.
Nothing in these Terms limits or excludes our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited by applicable UK law.
To the extent permitted by UK law:
- CarbonVerified.uk shall not be liable for any indirect, incidental, or consequential damages (including loss of profits) arising from your use of our service.
- Liability Cap: Our total liability for any claim shall not exceed the total amount you have paid to us in the 12 months preceding the claim (e.g., a maximum of £348 for monthly or £190 for annual subscriptions).
In the event of a personal data breach attributable to our systems, our total liability shall not exceed £1,000 or the total fees paid by you in the 12 months preceding the claim, whichever is greater.
5. Carbon Data Accuracy & Your Responsibility
Our platform generates carbon emission reports based on data you provide, using official UK Government (DESNZ) conversion factors. You acknowledge and agree that:
- You are solely responsible for the accuracy and completeness of all energy usage data, fuel consumption data, and any other information submitted to the platform.
- CarbonVerified.uk does not independently verify, audit, or validate the source data you provide.
- Any regulatory, contractual, or commercial consequences arising from inaccurate or incomplete data are your responsibility.
- Reports generated by this platform should be treated as self-verified estimates based on official conversion factors and do not constitute an independent third-party audit.
6. Badge & Certificate Usage Policy
CarbonVerified Pro subscribers receive access to verification badges, certificates, and QR codes for use in their business communications. By using these assets, you agree to the following:
- Badges and certificates indicate that you have self-verified your carbon emissions using official DESNZ conversion factors on the CarbonVerified.uk platform. They do not represent an independent third-party audit or accreditation.
- You must not use any CarbonVerified badge, certificate, or asset in a way that implies your emissions data has been independently audited unless a separate audit has been conducted.
- You must not use our badges to make misleading environmental claims about your products or services, in line with the CMA Green Claims Code and the FCA Anti-Greenwashing Rule.
- Use of badges is conditional on maintaining an active Pro subscription with up-to-date, truthful data. Badges must be removed within 30 days of subscription expiry or account termination.
7. Right to Cancel
As a gesture of goodwill, you may cancel your subscription within 14 days of your initial purchase for a full refund, provided you have not downloaded or generated any reports during that period. Please contact us at support@carbonverified.uk to initiate this process.
8. Termination and Data Export
- We may suspend or terminate your account immediately if you breach these Terms, in particular the Acceptable Use Policy in §2.
- You may terminate your subscription at any time from your dashboard. Termination takes effect at the end of your current billing period.
- You may terminate your subscription immediately and request a pro-rata refund if we materially breach these Terms and fail to remedy such breach within 14 days of written notice from you.
- Data export on exit: Upon cancellation or termination, you may request an export of your emissions data in CSV format by contacting support@carbonverified.uk within 30 days of account closure. After this period, your data will be permanently deleted in accordance with our Privacy Policy.
9. Data Processing
Where you submit personal data relating to your employees or other individuals to the platform (for example, employee commuting or business travel data), CarbonVerified.uk acts as a Data Processor and you act as the Data Controller in respect of that personal data, as defined under the UK General Data Protection Regulation (UK GDPR).
- By using the platform you agree to the terms of our Data Processing Addendum, which is incorporated into and forms part of these Terms. A copy is available on request at support@carbonverified.uk.
- We will process personal data only on your documented instructions and in accordance with UK GDPR Article 28.
- We will notify you without undue delay (and in any event within 72 hours) of becoming aware of a personal data breach affecting your data.
- Upon termination of your account, we will delete or return all personal data in accordance with your instructions and our Privacy Policy.
10. Intellectual Property
The following sets out the ownership and licence terms for all intellectual property connected with the platform and your use of it.
- Platform ownership: The CarbonVerified.uk platform, software, calculation engines, and all platform content remain the exclusive property of Paul Jacobs trading as CarbonVerified.uk. No rights in the platform are transferred to you by these Terms.
- Your data: You retain full ownership of all emissions data and business information you submit to the platform. You grant us a limited, non-exclusive, royalty-free licence to store and process that data solely for the purpose of providing the service to you.
- Generated outputs: Carbon Reduction Plan documents and reports generated by the platform using your data are owned by you. CarbonVerified.uk retains no rights in the content of your generated documents.
- IP indemnity: We will defend you against any third-party claim that the platform itself (excluding your input data) infringes UK intellectual property rights, provided you notify us promptly of any such claim.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes relating to these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
